Article 1 – Identity of the business
These general terms and conditions apply to the sale of products and, where applicable, the performance of 3D printing and custom-made assignments via the webshop and other sales channels of:
Automation Shop
Van Loy Solutions
Oosterwijk 70
2260 Westerlo
Belgium
Enterprise number: BE1041.697.351
E-mail address: info@automationshop.be
Telephone: +32 477 79 28 41
Website: https://www.automationshop.be
Hereinafter referred to as: "Automation Shop", "we", "us" or "our".
The natural person who makes a purchase or places an order primarily for private purposes is hereinafter referred to as "the consumer" or "you".
These general terms and conditions apply in particular to agreements between Automation Shop and consumers. If Automation Shop also enters into agreements with businesses or professional customers, separate B2B terms and conditions may apply.
Article 2 – Applicability
By placing an order or accepting a quotation, the consumer declares that they have read and agree to these general terms and conditions.
These general terms and conditions do not affect consumers’ statutory rights. If any provision conflicts with a mandatory statutory provision applicable to the agreement, the relevant statutory provision shall remain applicable.
The invalidity or unenforceability of any provision shall not affect the validity of the remaining provisions.
The general terms and conditions applicable to an agreement are those made available to the consumer before or no later than at the time the agreement is concluded.
Article 3 – Products and services
Automation Shop sells, among other things, smart home products and electronic equipment, including, for example, smart lights, switches, sensors, controllers and related products.
Automation Shop also offers a 3D printing service. This service may relate to:
standard or predefined 3D-printed products;
products manufactured based on specifications provided by the consumer;
personalised or customised 3D-printed products;
assignments discussed and priced in advance by means of a quotation.
The specific characteristics of a product or assignment are determined by the product description, technical specifications, any images and, in the case of custom-made work, the agreed specifications or quotation.
Article 4 – Product information
We strive to display product information, images, technical specifications, prices and availability information as completely and accurately as possible.
Minor differences in colour or appearance resulting from the settings or characteristics of the consumer’s screen do not in themselves constitute a lack of conformity.
Images on the website are for illustrative purposes unless expressly stated otherwise.
For 3D-printed products, minor visual or technical variations may occur as a result of the production process, the printer used, the material used or the characteristics of the chosen design. Such variations do not automatically constitute a defect, provided that the product still complies with the agreed specifications and the reasonable expectations that may be based on them.
Product information may be amended where necessary, for example due to changes made by a manufacturer or supplier. Such changes do not affect agreements already concluded, except where a legal basis or an obvious error applies.
Article 5 – Prices
All prices displayed to consumers include the applicable VAT unless expressly stated otherwise.
Any additional costs, such as shipping costs, will be clearly communicated before an order is placed or a quotation is accepted.
The consumer pays the price that was clearly communicated before the conclusion of the agreement and that is included in the order confirmation, quotation or other contractual confirmation.
Obvious errors in prices or other essential information may be corrected. Where there is an obvious error that the consumer could reasonably have recognised, we reserve the right not to perform the agreement. Any amounts already paid will be refunded in such a case.
Promotions, discount campaigns and offers are valid only during the stated period and while stocks last, unless otherwise indicated.
Article 6 – Orders via the webshop
The consumer can place an order by completing the ordering process on the website.
Before the order is finalised, the consumer is given the opportunity to check the order, the price, any delivery costs and the information entered, and to correct any errors.
By finalising the order, the consumer confirms that the order entails an obligation to pay.
After placing the order, the consumer will receive an electronic acknowledgement of receipt as soon as possible.
The agreement is concluded when Automation Shop confirms the order, for example by means of an order confirmation by e-mail, unless the order is refused or cancelled for a valid reason.
An automatic acknowledgement of receipt does not necessarily mean that the order has already been definitively accepted if it expressly states that it is only an acknowledgement of receipt.
If an order cannot be fulfilled, for example due to an obvious error, unavailability or another valid reason, the consumer will be informed as soon as possible and any amounts already paid will be refunded.
Article 7 – Quotations and custom-made assignments
For custom 3D printing or other assignments that cannot be ordered directly through the webshop, Automation Shop may provide a quotation.
A quotation may, among other things, be based on:
the supplied 3D file or design;
dimensions;
material;
colour;
print quality;
quantity;
required post-processing;
production time;
shipping costs;
any design or preparation work.
A quotation is valid for the validity period stated therein. If no validity period is stated, the quotation remains valid for 14 calendar days, unless otherwise indicated.
An agreement based on a quotation is concluded when the consumer expressly accepts the quotation within its validity period and, where applicable, has complied with the payment terms stated therein.
After acceptance of a quotation, the assignment cannot be unilaterally changed without Automation Shop’s consent. Any additional work or changes may result in an adjusted price and/or delivery period.
Where the consumer supplies files, designs, models, texts, images or other materials, the consumer is responsible for their accuracy and lawful use.
Automation Shop is not obliged to produce or use files where it can reasonably be assumed that doing so would infringe intellectual property rights or other rights of third parties.
Article 8 – 3D printing and technical feasibility
A 3D printing assignment is carried out on the basis of the agreed specifications.
Automation Shop may refuse an assignment if the supplied file, design or material is technically unsuitable for the requested production or if, based on a reasonable assessment, the assignment cannot be carried out in a technically responsible manner.
If, after accepting an assignment, it becomes apparent that performance is technically impossible or materially differs from what was originally agreed, Automation Shop will contact the consumer as soon as possible.
If no reasonable solution is found and the agreement therefore cannot be performed, the legal consequences will apply and any amounts already paid will be refunded insofar as the consumer is entitled to such a refund.
Minor production-related variations inherent to 3D printing which do not materially affect the agreed characteristics, functionality or normal use of the product do not in themselves constitute a lack of conformity.
Article 9 – Supplied designs and files
The consumer declares that they are entitled to have the files, designs, models, images or other materials supplied for a 3D printing assignment used and reproduced for the performance of the assignment.
The consumer remains responsible for any infringements of copyright, design rights, trademark rights, patents or other third-party rights arising from the material supplied by the consumer.
If Automation Shop reasonably suspects that an assignment infringes third-party rights or serves an unlawful purpose, performance may be refused.
This provision does not affect the consumer’s statutory rights.
Article 10 – Availability
Product availability is displayed as accurately as possible on the website.
An indication such as "in stock" means that, according to our current inventory data, the product is available for ordering.
If a product unexpectedly proves to be unavailable, we will inform the consumer as soon as possible.
If an order cannot be fulfilled within a reasonable period and the consumer validly terminates the agreement, any amounts already paid will be refunded in accordance with applicable legislation.
Article 11 – Delivery
We deliver to the delivery address provided by the consumer during the ordering process or agreed upon in the quotation.
The estimated delivery period will be communicated during the ordering process, in the quotation or on the website where possible.
For custom-made work and 3D printing assignments, the production time may differ from the normal delivery period for standard products. The expected production time will, where relevant, be communicated before the agreement is concluded.
Where no other delivery period has been agreed, the order will be delivered no later than 30 days after conclusion of the agreement, unless another statutory arrangement applies.
If we fail to deliver within the agreed or statutory delivery period, the consumer may, in cases where required by law, request that we complete delivery within an appropriate additional period.
If we also fail to deliver within that additional period, the consumer has the right to terminate the agreement, subject to statutory exceptions.
Where delivery within a specific period was essential and this was expressly agreed in advance, the consumer may, subject to the statutory conditions, terminate the agreement if delivery is not made on time.
In the event of termination due to non-delivery, we will refund all amounts paid by the consumer under the terminated agreement in accordance with applicable legislation.
Article 12 – Shipping and carrier
We choose the carrier that we consider most suitable for the relevant order, unless otherwise agreed.
Where available, the consumer will receive a shipping confirmation and possibly a Track & Trace code.
A Track & Trace status may only become visible some time after the shipment has been handed over to the carrier.
A delay, loss or damage during normal transport arranged by Automation Shop does not release Automation Shop from its obligations towards the consumer under the agreement and applicable legislation.
In the event of a delivery problem, the consumer is not required to resolve the matter exclusively with the carrier. The consumer may contact Automation Shop.
Article 13 – Transfer of risk
In a sale to a consumer, the risk of loss of or damage to the goods passes to the consumer at the time when the consumer or a third party designated by the consumer, other than the carrier, physically takes possession of the goods.
If the consumer personally chooses a carrier that was not offered by Automation Shop, the risk may pass to the consumer earlier in accordance with applicable legislation.
Article 14 – Inspection upon delivery
The consumer is requested to check upon receipt whether the packaging and goods are visibly damaged.
Any visible damage may be reported to us as soon as possible, preferably with photographs and a description of the damage.
Failure to report visible damage immediately does not affect the consumer’s statutory rights regarding conformity, guarantee or withdrawal.
Article 15 – Right of withdrawal for standard products
When the consumer concludes a distance agreement online for goods for which no statutory exception to the right of withdrawal applies, the consumer is in principle entitled to withdraw from the agreement within 14 calendar days without giving any reason.
For the purchase of goods, this period begins on the day after the day on which the consumer or a third party designated by the consumer, other than the carrier, physically takes possession of the goods.
For an order consisting of multiple goods delivered separately, the period begins on the day after receipt of the last item.
The consumer may exercise the right of withdrawal by providing us, within the withdrawal period, with an unequivocal statement indicating that the consumer wishes to withdraw from the agreement.
The consumer may use the model withdrawal form at the end of these general terms and conditions for this purpose, but is not obliged to do so.
A withdrawal may be communicated via:
E-mail address: retour@automationshop.be
Postal address: Oosterwijk 70, 2260 Westerlo, Belgium
The consumer does not have to give a reason for the withdrawal.
Article 16 – Exception: custom-made and personalised 3D products
The statutory right of withdrawal does not apply to goods manufactured according to the consumer’s specifications or clearly intended for a specific person, provided that the statutory conditions for this exception are met.
This may apply, among other things, to 3D-printed products manufactured specifically for the consumer based on the following information provided by the consumer:
dimensions;
shape;
design;
text;
image;
colour;
material;
technical specifications;
other personal or specific requirements.
The fact that a product is only produced after an order is placed does not in itself necessarily mean that it is a custom-made product. The exception is applied only where the statutory conditions for it have actually been met.
If a product is offered as a custom-made or personalised product, the consumer will be clearly informed before conclusion of the agreement that the statutory right of withdrawal does not apply to that product where the statutory exception applies.
The absence of a right of withdrawal for custom-made products does not affect the consumer’s statutory rights in the event of a lack of conformity, incorrect performance or another problem for which Automation Shop is legally responsible.
Article 17 – Other exceptions to the right of withdrawal
The right of withdrawal does not apply in other cases where the law provides for an exception.
Where applicable, this may include:
goods manufactured according to the consumer’s specifications or clearly intended for a specific person;
sealed goods which are not suitable for return for reasons of health protection or hygiene where the seal has been broken after delivery;
goods which, by their nature, have become inseparably mixed with other goods after delivery;
sealed audio or video recordings or computer software where the seal has been broken after delivery;
digital content which is not supplied on a tangible medium, where performance has begun with the consumer’s prior express consent and the consumer has acknowledged that this results in the loss of the right of withdrawal;
other agreements for which the right of withdrawal is excluded under applicable legislation.
Where a statutory exception to the right of withdrawal applies, the consumer will be clearly informed of this before the agreement is concluded.
Article 18 – Withdrawal from agreements involving a service
Where Automation Shop provides a separate service to a consumer and a right of withdrawal applies to that agreement, the statutory rules regarding withdrawal from services apply.
Where the consumer expressly requests that performance of a service begin before the end of the withdrawal period, the consumer will be informed before performance begins of the statutory consequences thereof.
If a service has been fully performed after the consumer has expressly agreed in advance to performance during the withdrawal period and acknowledged that this results in the loss of the right of withdrawal, the right of withdrawal lapses in accordance with applicable legislation.
Insofar as a 3D printing assignment is legally considered an agreement for the supply of goods, Article 16 remains applicable where the statutory exception for custom-made goods applies.
Article 19 – Consequences of withdrawal
Where the consumer validly withdraws from the agreement, the agreement and the associated obligations are terminated in accordance with applicable legislation.
The consumer must return or hand over the goods to us without undue delay and no later than 14 calendar days after informing us of the withdrawal, unless we have offered to collect the goods ourselves.
The consumer bears the direct cost of returning the goods, unless we have expressly indicated that we will bear these costs or the consumer was not correctly informed of these costs in advance.
The consumer is liable only for any reduction in value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
Merely opening the packaging does not automatically result in the consumer losing the right of withdrawal.
Article 20 – Refund upon withdrawal
In the event of a valid withdrawal, we will refund all payments received from the consumer, including standard delivery costs.
If the consumer has expressly chosen a more expensive delivery method than the least expensive standard delivery method we offer, we are not required to refund the additional costs of that more expensive method.
We may withhold the refund until we have received the goods back or until the consumer has provided evidence that the goods have been returned, whichever occurs first.
The refund will in principle be made using the same means of payment as used for the original transaction, unless the consumer expressly agrees to another method and this does not result in any costs for the consumer.
Article 21 – Return procedure
For a return under the right of withdrawal, the consumer can contact us via:
E-mail address: retour@automationshop.be
Return address:
Automation shop
Oosterwijk 70 2260 Westerlo Belgium
The return procedure is intended to facilitate smooth processing and does not in any way limit the consumer’s statutory rights.
Goods returned under the statutory guarantee or due to non-conformity are not considered an ordinary return under the right of withdrawal.
Custom-made products to which the statutory exception to the right of withdrawal applies cannot be returned on the basis of the right of withdrawal. This does not affect the consumer’s statutory rights in the event of a lack of conformity or incorrect performance.
Article 22 – Statutory guarantee of conformity
New goods are covered by the statutory guarantee of conformity as provided for under Belgian legislation.
Consumers are in principle entitled to a statutory guarantee of conformity of two years from delivery of the goods, provided that the statutory conditions are met.
The statutory guarantee may also apply to 3D-printed goods and custom-made products. The fact that a product was custom-made does not exclude the statutory guarantee of conformity.
The statutory guarantee applies to any lack of conformity that existed at the time of delivery and that falls within the statutory framework.
For second-hand goods, a shorter guarantee period of at least one year may be agreed if this is clearly and unambiguously communicated before purchase and is legally permitted.
The statutory guarantee is separate from any commercial or manufacturer’s warranty. A commercial guarantee cannot limit the consumer’s statutory rights.
Where a product is not in conformity, the consumer may, subject to statutory conditions, be entitled to statutory remedies, including repair or replacement and, where provided for by law, a price reduction or termination of the agreement.
The seller is responsible for the statutory guarantee of conformity towards the consumer. The consumer does not have to contact the manufacturer exclusively in order to exercise their statutory rights.
Article 23 – Notification of a conformity issue
If the consumer identifies a conformity issue during the statutory guarantee period, the consumer can contact us via:
E-mail address: klantendienst@automationshop.be
The consumer should preferably describe the issue as clearly as possible and, where relevant, attach photographs, videos or other useful information.
We may ask the consumer to return the product for assessment or repair where this is reasonably necessary.
Where the issue is covered by the statutory guarantee, the statutory remedies will be provided free of charge in accordance with applicable legislation.
For electronic smart home products, Automation Shop may, where reasonably necessary, request certain basic information about the installation, configuration or circumstances in which the issue occurs.
Such a request for information does not limit the consumer’s statutory rights.
Article 24 – Product use, installation and safety
The consumer undertakes to use products in accordance with their intended purpose, the instructions provided and the manufacturer’s safety instructions.
For smart home products, the manufacturer’s installation, connection and operating instructions must be followed.
Where a product requires electrical connections or other technical work that must, under applicable regulations, be carried out by an authorised person, the consumer must engage an authorised person for this purpose.
Automation Shop is not responsible for damage resulting solely from incorrect installation, connection, configuration or other improper use by the consumer, insofar as such a limitation is legally permitted.
This article does not in any way limit Automation Shop’s statutory liability or the consumer’s statutory rights.
Article 25 – 3D-printed products and use
3D-printed products must be used in accordance with their intended purpose and any operating and safety instructions supplied with the product.
A 3D-printed product must not be used without prior assessment for applications where its defect or failure could reasonably result in serious personal injury, death, fire, serious property damage or another safety-critical situation.
Where a 3D-printed product has been offered exclusively as a decorative, organisational, prototype or non-safety-critical product, it must not be regarded as a certified safety-critical component without additional technical assessment.
This provision does not limit Automation Shop’s statutory product liability or other mandatory statutory obligations.
Article 26 – Liability
We are liable for damage for which we are liable under applicable legislation.
No provision of these general terms and conditions excludes or limits liability where such exclusion or limitation is not legally permitted.
Among other things, we are not released from statutory obligations relating to product conformity, statutory guarantees, consumer protection or other mandatory statutory liabilities.
Insofar as legally permitted, we are not liable for damage resulting solely from incorrect, careless or improper use of a product by the consumer, where such use is the cause of the damage.
Insofar as legally permitted, we are likewise not liable for damage resulting solely from information, files, designs or other materials supplied by the consumer which Automation Shop could not reasonably have known were incorrect or unsuitable.
None of these provisions limits the rights the consumer has under mandatory law.
Article 27 – Intellectual property
All texts, images, logos, designs, product photographs, graphic elements and other content on the website are protected by applicable intellectual property rights, unless otherwise indicated.
It is not permitted to reproduce, distribute or commercially use this content in whole or in part without prior written permission, subject to statutory exceptions.
The intellectual property rights of manufacturers, brands and other third parties remain with their respective rights holders.
When a consumer supplies their own design or file for a 3D printing assignment, the intellectual property rights therein remain with the rights holder.
Performance of a 3D printing assignment does not automatically result in the transfer of intellectual property rights.
Article 28 – Reviews and feedback
When the consumer submits a rating, review, photograph, video or other feedback, the consumer declares that they have the necessary rights to share this content.
The consumer grants Automation Shop, insofar as necessary for displaying and promoting the relevant review or feedback, a non-exclusive right of use.
We may remove reviews or feedback where they are, for example, unlawful, misleading, discriminatory, insulting, spam or otherwise contrary to the applicable rules.
We will not manipulate reviews in such a way as to give consumers a misleading impression of other customers’ experiences.
Article 29 – Links to third-party websites
Our website may contain links to third-party websites.
We are not responsible for the content, operation, availability or privacy practices of websites that are not operated by Automation Shop.
When a consumer visits a third-party website, the terms and privacy rules of that third party apply.
Article 30 – Shopify and other service providers
Our webshop is technically supported by Shopify and possibly other service providers.
However, the sales agreement is concluded directly between Automation Shop and the consumer.
Shopify and other technical service providers are not parties to the sales agreement between Automation Shop and the consumer, unless expressly agreed otherwise.
This does not affect the consumer’s rights against Automation Shop.
Article 31 – Personal data
Personal data is processed in accordance with our separate privacy policy.
The privacy policy is available at:
https://www.automationshop.be/policies/privacy-policy
Personal data is processed in accordance with the applicable privacy legislation, including the General Data Protection Regulation (GDPR).
Article 32 – Cookies
For the use of cookies and similar technologies, we refer to our separate cookie policy:
https://www.automationshop.be/policies/privacy-policy
Where user consent is required for certain cookies, this consent will be requested in accordance with applicable legislation.
Article 33 – Complaints
We endeavour to resolve complaints as quickly as possible and by mutual agreement.
Complaints may be addressed to:
Automation Shop
Oosterwijk 70, 2260 Westerlo, Belgium
E-mail: klantendienst@automationshop.be
Telephone: +32 477 79 28 41
We ask the consumer to describe the complaint as clearly as possible and, where relevant, to include the order number and supporting documents.
The consumer always retains the right to make use of statutory out-of-court or judicial procedures.
Article 34 – Out-of-court dispute resolution
Where a dispute cannot be resolved directly, the consumer may, provided the applicable conditions are met, make use of a competent Belgian out-of-court dispute resolution mechanism.
For consumers residing in Belgium, the Consumer Mediation Service may, among others, be consulted where the statutory conditions are met.
More information:
https://www.consumentenombudsdienst.be/
Use of an out-of-court dispute resolution mechanism does not affect the consumer’s right to bring a case before a competent court.
Article 35 – Force majeure
Where circumstances beyond our reasonable control temporarily prevent us from fulfilling an obligation, we will inform the consumer as soon as reasonably possible.
Force majeure may include, for example, serious disruptions to telecommunications or information systems, natural disasters, war, government measures, strikes or other circumstances reasonably beyond our control.
Force majeure does not release us from obligations which, under mandatory law, continue to apply even in such circumstances.
Where performance of the agreement becomes permanently impossible, the statutory consequences thereof will apply.
Article 36 – Amendments to the general terms and conditions
We may amend these general terms and conditions in the future.
The version applicable to an order or assignment is the version communicated or made available to the consumer at the time the agreement is concluded.
Amendments do not affect agreements already concluded, unless a statutory provision provides otherwise.
Article 37 – Applicable law
These general terms and conditions and the agreement between Automation Shop and the consumer are governed by Belgian law, insofar as this is compatible with mandatory statutory provisions protecting the consumer.
Where the consumer resides in another Member State of the European Union, the mandatory consumer protection rules applicable to the consumer under the applicable rules of private international law remain unaffected.
Article 38 – Competent court
Disputes shall be subject to the jurisdiction of the courts that have jurisdiction under the applicable statutory rules.
No provision of these general terms and conditions is intended to deprive the consumer of the right to bring a dispute before a court that has jurisdiction under mandatory law.
